Overtime pay UAE briefing from OPS
|
How do you calculate overtime pay in the UAE? Short answer: Overtime pay UAE rules sit in Article 19 of Federal Decree-Law No. 33 of 2021. Hours beyond normal working hours are paid at the wage for those hours, calculated on the basic wage, plus not less than 25%. Where the overtime falls between 10pm and 4am the supplement is not less than 50%, which does not apply to employees working on a shift basis. Rest-day work earns a substitute rest day or that day’s wage plus not less than 50% of the basic wage. Additional hours are generally limited to 2 a day, and total working hours to 144 every 3 weeks. |
Overtime disputes can arise from differences between hours worked, hours approved, payroll records and amounts paid. Employers should maintain a clear audit trail to support accurate calculations and demonstrate compliance.
What Counts as Overtime Under UAE Labour Law
Article 17 sets maximum normal working hours at 8 a day or 48 a week, and a full-time worker may not be required to work beyond contracted hours without written consent. Article 18 limits continuous work to 5 hours without a rest break, and Article 15 of Cabinet Resolution No. 1 of 2022 reduces normal hours by 2 during Ramadan.
The two limits on additional hours
Under Article 19(1) of Federal Decree-Law No. 33 of 2021, an employer may require additional working hours, generally limited to two hours per day. Exceptions apply where the work is necessary to prevent substantial loss or a serious accident, or to reduce its effects, subject to the Executive Regulations.
Total working hours must not exceed 144 hours every three weeks. Employers should monitor across three-week periods rather than relying on calendar-month payroll summaries, which will not surface a breach. That monitoring is a compliance control rather than a prescribed calculation.
Overtime Pay Rates in the UAE, and Which Wage They Sit On
Overtime pay UAE rates are set by Article 19. The table below gives each situation with its governing provision.
| Situation | Statutory minimum entitlement | Provision |
|---|---|---|
| Hours beyond normal working hours | The wage for the equivalent normal hours, on the basic wage, plus not less than 25% | Article 19(2) |
| Overtime between 10pm and 4am | The same calculation with an increase of not less than 50%. Not applicable to employees working on a shift basis | Article 19(3) |
| Work on the contractual rest day | A substitute rest day, or that day’s wage at the normal rate plus not less than 50% of basic for that day. No more than 2 consecutive rest days, day labourers excluded | Article 19(4) and 19(5) |
| Limits on additional hours | Generally 2 additional hours a day, subject to the substantial-loss and serious-accident exceptions; 144 total working hours every 3 weeks | Article 19(1); Cabinet Resolution No. 1 of 2022, Article 15 |
These are statutory minimums, calculated on the basic wage. A contract or policy may provide more favourable terms, and where it does, the more favourable term applies. Payroll should be configured to whichever basis the employment documentation sets, not to a system default.
Basic wage or total wage?
Article 1 defines the basic wage as contractual pay for the work, excluding allowances and benefits in kind. The published English text of Article 19 calculates the overtime hour on the basic wage and expresses both supplements as a percentage of that wage. The Arabic text prevails. Where the contract is silent, confirm the treatment with MOHRE or a qualified adviser.
The MOHRE calculation method
MOHRE’s published guidance illustrates the hourly-rate calculation using monthly basic salary divided by 30 days and then by 8 hours. On a monthly basic salary of AED 6,000, with an 8-hour normal day, that gives AED 25 an hour.
| Step | Amount |
|---|---|
| Monthly basic salary | AED 6,000 |
| Hourly rate, 6,000 divided by 30 then by 8 | AED 25.00 |
| Normal overtime hour at 125% | AED 31.25 |
| Night overtime hour at 150% | AED 37.50 |
Employers should check the applicable working arrangements, contracts and any more favourable terms. A different divisor should not be treated as equally supported by official guidance without legal confirmation.
Rest Days and Official Holidays Are Not the Same Thing
Work on the contractual weekly rest day falls under Article 19(4), set out above. Official public holidays are a separate entitlement under Article 28 of Federal Decree-Law No. 33 of 2021, and the two should not be treated as interchangeable in payroll. The compensation for an official holiday comes from a different provision.
Compliance check required: confirm the compensation for work on an official holiday against the current text of Article 28 and MOHRE guidance before configuring it in payroll.
Who Sits Outside the Overtime Rules
Article 20 leaves the exempt categories to the Executive Regulations. Article 15 of Cabinet Resolution No. 1 of 2022 names them: board chairmen and members; supervisory staff who enjoy the capacities of an employer; sea crews with special service conditions; shift or rotating activities averaging no more than 56 hours a week; and preparatory or supplementary work outside general hours.
These categories should not be applied on the strength of a job title. The supervisory test turns on the authority exercised.
Shift workers: two different exclusions
Two exclusions apply to shift work and conflating them is a common configuration error. Employees on shifts are excluded from the night supplement in Article 19(3). Separately, shift or rotating activities may fall within the working-hours exemption in Article 15 of Cabinet Resolution No. 1 of 2022 where average hours do not exceed 56 a week. Falling inside the first does not place an employee inside the second, and neither removes other overtime protection.
Ordinary free zones, DIFC and ADGM
Ordinary UAE free zones are not the same as the financial free zones. The UAE Government portal states that free-zone employees are generally governed by the relevant authority’s employment regulations together with the federal law, typically aligned with it, so Article 19 is usually the starting point.
DIFC and ADGM are different. Federal Law No. 8 of 2004 exempts financial free zones from federal civil and commercial laws, and each operates its own employment framework with its own working-time provisions. In ADGM, the Employment Regulations 2024 took effect on 1 April 2025, replacing the 2019 Regulations. They do not prescribe a general express overtime premium in the way Article 19 does, which is not the same as saying an overtime entitlement cannot arise: contractual entitlements, any rules or guidance issued by the Registrar, and working-time restrictions still apply. Employers should apply the legislation governing their own financial free zone. OPS covers the wider differences in free zone versus mainland payroll.
Approving Overtime Before It Reaches Payroll
An overtime pay UAE calculation is only as reliable as the hours that reach payroll. Overtime is often created by someone with no payroll accountability, frequently a site supervisor at the end of a shift. The controls below are recommended practice, not statutory conditions.
| Control point | When | What it supports |
|---|---|---|
| Supervisor approval | Before the hours are worked, where practicable | Cost control, and a record of who authorised the work |
| Three-week total | At capture and at cut-off | Monitoring against the 144-hour limit, which a calendar-month view hides |
| Night-hours split | At capture | Applying the correct rate to hours between 10pm and 4am |
| Rest-day and holiday flags | At capture | Keeping Article 19(4) rest-day work and Article 28 holiday work on separate treatments |
| Wage-base and rate check | At configuration, and on contract template changes | Alignment between the calculation and the employment documentation |
| Variance review and documented approval | Before the bank file | An explained movement, and a payment accepted by a named approver |
Approval before the hours are worked is an internal control, not a legal prerequisite to an entitlement. Disputes can still arise where overtime was worked. See the sign-off step providers skip, the responsibility matrix, and how overtime meets leave and final pay in the UAE annual leave guide and end-of-service benefits.
Employee Records and the Overtime Audit Trail
Article 13(1) of Federal Decree-Law No. 33 of 2021 requires employers to maintain employee files and records, and to retain the employee file for a period of not less than two years after the employee’s end of service, subject to applicable ministry requirements.
UAE labour legislation does not prescribe a single overtime-timesheet format. That absence does not remove the statutory record-keeping obligation. A practical overtime audit trail should identify the employee, work date, normal hours, additional hours, applicable rate, supervisor approval and payment record, which helps employers demonstrate compliance and answer complaints.

OPS expert view Overtime disputes tend not to turn on the percentage. Both sides can read Article 19 and reach the same rate. They turn on the gap between four records: hours worked, hours approved, what payroll calculated, and what was paid. Those four should reconcile, and in many organisations nobody has checked whether they do. The practical test is whether a single overtime line on a payslip traces back to a date, a shift window and an approver. Where overtime arrives as one monthly figure per employee, that trace does not exist, and rebuilding it later is harder than capturing it at the time. |
What This Means for HR, Payroll and Finance
| Function | What to own |
|---|---|
| HR | Classification and exemption decisions, evidenced rather than assumed from job titles. The wage base in the contract or policy, Article 17 written consent, and the Article 13 employee file |
| Payroll | The night window as a time split rather than a manual code. The three-week total as a reportable field. Rest-day and holiday work on separate treatments. Overtime recorded as hours with attributes, not as a value |
| Finance | Overtime as a variance indicator. It can move without a headcount change, so an unexplained movement is worth a question before sign-off |
How OPS Handles Overtime in the Monthly Cycle
Each client entity is configured to its own payroll calendar, approval flow and statutory rules, confirmed during implementation and maintained through OPS’s monthly payroll governance. Where time and attendance, approval workflows or payroll integrations form part of the agreed service scope, overtime can reach the run as approved hours carrying the date, the shift window and the approver rather than a single monthly value. The functionality in scope is agreed during scoping and set out in the service documentation.
Validation, QA and variance review run before anything reaches a bank file, and nothing is released until the client signs off. OPS supports payroll requirements across the GCC, including the United Arab Emirates, Saudi Arabia, Bahrain, Kuwait, Oman and Qatar, and selected markets beyond, while expanding its payroll capabilities in Morocco and Tunisia. Country-specific service availability and delivery arrangements are confirmed during client scoping.
Frequently Asked Questions
How do you calculate overtime pay in the UAE?
Under Article 19(2) of Federal Decree-Law No. 33 of 2021, an overtime hour is paid at the wage for an equivalent normal hour, calculated on the basic wage, plus not less than 25%. Between 10pm and 4am the increase is not less than 50% under Article 19(3), which does not apply to shift workers. MOHRE’s published guidance illustrates the hourly rate using monthly basic salary divided by 30 days then by 8 hours. These are minimums; a contract may be more favourable.
What is the overtime rate for night shift in the UAE?
Article 19(3) provides that overtime between 10pm and 4am is paid at the wage for the equivalent normal hours, calculated on the basic wage, plus not less than 50%. It does not apply to employees on a shift basis. That exclusion is specific to the night supplement and separate from the working-hours exemption in Article 15 of Cabinet Resolution No. 1 of 2022, so both should be assessed.
Is overtime in the UAE calculated on basic salary or total salary?
The published English text of Article 19 calculates the overtime hour and both supplements on the basic wage, which Article 1 defines as contractual pay excluding allowances and benefits in kind. That is a minimum, so a contract may set a more favourable basis and applies where it does. The Arabic text prevails. Fix the basis in the contract or a written policy.
What is the maximum overtime allowed in the UAE?
Under Article 19(1), additional working hours are generally limited to two hours per day, with exceptions where the work is necessary to prevent substantial loss or a serious accident, or to reduce its effects. Total working hours must not exceed 144 hours every three weeks, which employers should monitor across three-week periods rather than by calendar month.
Is working on a public holiday the same as working on a rest day in the UAE?
No. Work on the contractual weekly rest day falls under Article 19(4), which gives a substitute rest day or that day’s wage plus not less than 50% of the basic wage. Official public holidays are a separate entitlement under Article 28, and the compensation comes from a different provision. Configure the two separately, and confirm the Article 28 treatment against the current text and MOHRE guidance.
Does an employer have to keep overtime records in the UAE?
Article 13(1) of Federal Decree-Law No. 33 of 2021 requires employers to maintain employee files and records, and to retain the employee file for not less than two years after end of service, subject to ministry requirements. UAE labour legislation does not prescribe a single overtime-timesheet format, and that absence does not remove the statutory obligation.
Does the UAE overtime law apply in DIFC and ADGM?
Not directly. Federal Law No. 8 of 2004 exempts financial free zones from federal civil and commercial laws, so DIFC and ADGM operate their own employment frameworks and working-time provisions. In ADGM, the Employment Regulations 2024, in force from 1 April 2025, do not prescribe a general express overtime premium in the way Article 19 does, which is not the same as saying an entitlement cannot arise: contractual terms, any rules issued by the Registrar, and working-time restrictions still apply. Ordinary free zones are generally governed by the relevant authority’s rules together with the federal law.
